Who runs SMS Democrat, the terms for using the site and its free tools, and the law that applies. By using the site you accept these terms.

1. Who owns this website

In accordance with Article 10 of Spanish Law 34/2002 of 11 July on Information Society Services and Electronic Commerce (LSSI-CE), the owner of sms.democrat (“the site”) is:

In these terms, “we” and “us” mean Pro Commons Developers S.L., and “you” means anyone who visits or uses the site.

2. What the site is

SMS Democrat is a free, independent educational resource about reaching people through SMS and WhatsApp. It offers calculators, generators, templates and checklists, plus articles and guides. You don't need an account to use it, and we don't sell anything through it. The site is funded by advertising and, where marked, affiliate links.

SMS Democrat is not affiliated with, or endorsed by, any political party, candidate, campaign, WhatsApp, Meta, or any messaging provider or carrier mentioned on the site.

3. Using the site

You can use the site freely, provided you:

  • use it lawfully, in good faith, and in line with these terms;
  • don't try to damage, overload or break into the site, its server or its admin area, or get around its security measures;
  • don't use automated tools to copy the site on a scale that affects how it works for others;
  • don't introduce viruses or other harmful code.

We may restrict access for anyone who breaks these terms, and we may change, suspend or withdraw the site or any tool at any time without notice.

4. Your messaging campaigns are your responsibility

The tools help you plan and prepare messages. They don't send anything, and we have no part in any campaign you run. You alone are responsible for how you use what the tools produce, and for complying with the laws and rules that apply to your messages. Depending on where you and your recipients are, these can include consent and opt-out rules (such as the US TCPA and carrier/CTIA guidelines, or the EU GDPR and ePrivacy rules), A2P 10DLC registration, quiet-hours limits, electoral and campaign finance law, and each platform's terms (for example, WhatsApp's restrictions on political use).

5. No legal or professional advice

Everything on the site is general information, provided as is. Cost figures are estimates based on published list prices and exchange rates on the date shown, and real prices vary by provider, volume and contract. Compliance guidance, templates and checklists are simplified summaries, not legal advice, and laws and platform rules change. We try to keep things accurate and up to date but can't guarantee it. Before relying on anything here, check it against current law and your providers' terms, and ask a qualified lawyer where it matters.

6. Intellectual property

Unless stated otherwise, the site's content — texts, guides, design, logos, tools and their code — belongs to Pro Commons Developers S.L. or is used with permission, and is protected by intellectual and industrial property law. You may:

  • use the tools and copy the text they generate for you, including for your own campaigns;
  • link to any page of the site;
  • quote short excerpts, with a credit and a link to the original page.

Any other reproduction, distribution, public communication or transformation of the content needs our prior written permission.

Some content comes from third parties under their own licences. WhatsApp price data comes from the WhaTools dataset, licensed under CC BY 4.0. Names such as WhatsApp, Meta, Google, Twilio and others are trademarks of their owners and are used only to identify their products; their use doesn't imply any relationship with or endorsement by them.

If you think something on the site infringes your rights, write to [email protected] and we'll look into it promptly.

7. Links to other websites

The site links to third-party websites, including our companion project wha.tools, official documentation and service providers. We don't control those sites and aren't responsible for their content, availability or privacy practices. A link isn't an endorsement. If we learn that a linked page contains unlawful content, we'll remove the link promptly.

Some links may be affiliate links: if you sign up through them, we may earn a commission at no extra cost to you. They are marked on the page where they appear.

8. Advertising

The site may show ads served by Google AdSense. Ads are chosen by Google and its partners, not by us, and showing an ad doesn't mean we endorse the advertiser. Advertising cookies are only used if you accept them; see the cookie policy.

9. Liability

We work to keep the site available, secure and accurate, but we can't guarantee that it will always be available or free of errors, or that the information and tool results will be complete, accurate or suitable for your purpose. To the extent the law allows, we are not liable for loss or damage arising from:

  • interruptions, errors or unavailability of the site;
  • decisions you take, or messages you send, based on the site's content or tool results;
  • the content of third-party websites and ads;
  • viruses or harmful code, despite the reasonable security measures we have in place.

Nothing in these terms limits or excludes liability that can't be limited or excluded by law, such as liability for wilful misconduct or gross negligence, or your rights as a consumer.

10. Privacy and cookies

How we handle personal data is explained in our privacy policy, and the cookies we use are listed in our cookie policy.

11. Changes to these terms

We may update this notice to reflect changes to the site or the law. The version that applies is the one published here when you use the site, and the date at the top shows when it last changed.

12. Applicable law and jurisdiction

These terms are governed by Spanish law. Any dispute will be resolved by the courts of Barcelona (Spain), unless the law gives you, as a consumer, the right to go to the courts where you live, in which case you keep that right.
